BUYER/SELLER CONTRACT FOR PET DOG/PUPPY

The following contract is between the breeder, Paloma Labrador Retrievers, to be known hereafter as the seller and
_______________________________________________to be known hereafter as the buyer.
This agreement is made and entered this _______day of ____________20____by and between PALOMA LABRADOR RETRIEVERS (seller) and
_______________________________________________(Buyer), for the purpose of setting forth the terms and conditions of purchase by the Buyer of a purebred Labrador retriever from the litter whelped on __________________ out of
__________________________and __________________________.
For $________________, the seller agrees to sell and the buyer agrees to purchase a
Color: Yellow / Black / Chocolate
female_____, male______ companion puppy from the litter described above subject to the following terms.
A non-refundable deposit of $_________ is required to hold a specific puppy. If the puppy is not available (due to health, wrong gender, color, etc.), 100% of the deposit will be
refunded. If the buyer changes his mind after the Seller receives deposit, it will be retained for care and advertising of dog/puppy until suitable placement can be
arranged. Seller has the option to terminate sale and return 100% of deposit fee priorto placement of puppy. There will be NO REFUND of deposits after a 30 day period for puppies.
THIS CONTRACT IS NOT TRANSFERABLE. THIS CONTRACT IS ONLY FOR DOG/PUPPIES PURCHASED FOR COMPANION DOGS ONLY. IF BUYER BUYS WITH FULL REGISTRATION HE/SHE DOES SO WITH NO WARRANTY/GUARANTEE.
Purchase price does not include the cost of shipping, crate and bill of health. These costs will be the responsibility of the buyer.
1. HEALTH
Seller warrants that the above-described dog/puppy is in good health at the time Buyer assumes ownership. As this dog/puppy is being purchased as a companion pet, the seller recommends to the buyer that said dog/puppy be neutered or spayed when it reaches maturity. None of the puppies born at Paloma Labs have their dewclaws removed. We feel this is unnessesary and cruel. We leave microchipping to the new owners so that the pup is registered in the owners name.
Please note that we have a warranty for hip dysplasia only as stated below. If the buyer decides to surrender or return said puppy back to owner for any reason (health of said dog, behavioral issues, divorce, moving, financial), there will be NO refund.
2. SATISFACTION GUARANTEE
Buyer agrees to have the puppy examined by a licensed Veterinarian within two (2) days (not including Sunday's and holidays) of receipt of dog/puppy. Said dog may be returned to the seller for any reason within the two(2) days following purchase. Provided that the dog/puppy has not been damaged in any way the buyer will then be entitled to a refund of the original purchase price less the non-refundable deposit.
The seller does not assume any liability for any injury or sickness contracted on the buyers property or after the 48 hours of receipt of dog/puppy (this includes parasites and protozoan diseases). Seller shall not be held responsible for acts of dog/puppy which are due to buyers negligence.
If said dog/puppy has to be shipped back, these costs will be the responsibility of the buyer.
All appropriate shots for the dog/puppy’s age have been given, and a record of this vaccination history is supplied.
The buyer agrees to maintain the dog/puppy’s health in good condition, and to provide yearly examinations, vaccinations, heartworm test, and any other usual procedures necessary to assure good health. The buyer agrees to provide a suitable fenced area for this dog/puppy. This dog/puppy shall also have adequate and proper shelter and housed securely.
The buyer agrees that this dog/puppy will not be tied out or chained unless supervised for the duration by an adult. The buyer agrees to feed a high quality dog food and have fresh water available to said dog/puppy. The seller recommends obedience training.
3. AKC REGISTRATION
PALOMA LABRADOR RETRIEVERS certifies that the dog/puppy is eligible for registration under the Regulations of the American Kennel Club as a purebred Labrador retriever and will provide the proper forms for such a registration. This dog/puppy has been purchased for a pet, and to warrant against irresponsible breeding PALOMA LABRADOR RETRIEVERS sell all their dogs/puppies under LIMITED REGISTRATION.
Limited registration means that the dog is registerable with the AKC, however , any offspring produced by the dog would not be eligible. This does not prevent the dog to compete in any AKC event except for the conformation ring.
Registration papers will be furnished to the Buyer when the final payment of the dog/puppy has been made. If the final payment is a personal check, we will mail the registration papers to the buyer when the check has cleared the bank.
Dog/Puppy will carry the “PALOMA” kennel name as a prefix.
4. HIP WARRANTY
This warranty is only valid for 26 months from the date of birth of said dog/puppy.
Said dog/puppy must not have been bred or sired a litter for this warranty to be effective.
The Buyer should educate himself/herself to proper nutrition of the dog so as not to induce joint problems of either lack of nutrition or by causing an overweight condition in a developing dog/puppy.
The seller warrants that both the sire and dam’s hips have been X-rayed and evaluated by the Orthopedic Foundation for Animals (OFA) in the United States and have been found to be of the grade of Fair or better by the OFA and are free of canine hip dysplasia.
It is understood that Hip Dysplasia can be caused by poor nutrition or injury and that the dog/puppy is guaranteed to the extent of GENETIC Hip Dysplasia only.
In the event of GENETIC hip dysplasia that warrants euthanization of the dog/puppy before the age of 26 months, the seller agrees to replace said dog/puppy with puppy of same quality.
The following conditions must be met:
1. Buyer notifies Sellers promptly after such condition is diagnosed and not later than
the dog/puppy reaching 26 months of age.
2. A copy of OFA’s refusal must be sent to the Sellers.
3. The dog/puppy must not have been bred or sired a litter.
4. A certificate of euthanization from a licensed Veterinarian for said dog/puppy and
written statement of the diagnosis.
Please note that the sellers do not require euthanization of said dog/puppy, but if said dog/puppy does develop GENETIC HIP DYSPLASIA before the age of 26 months, the seller will refund 50% of purchase price. A dog/puppy who is found to have a mild condition, which will not in any way shorten or diminish the quality of life for that dog/puppy, WILL NOT BE REPLACED.
These following conditions must be met:
1. Buyer notifies Sellers promptly after such condition is diagnosed and not later than
the dog/puppy reaching 26 months of age.
2. A copy of OFA’s refusal must be sent to the seller.
3. Said dog/puppy must not have been bred or sired a litter.
4. Said dog/puppy must be neutered or spayed with written proof from a licensed
veterinarian. This should be sent to the sellers.
BUYER’S ACKNOWLEDGMENT:
The Buyer by signing this contract acknowledges and understand its contents and has entered into this agreement freely.
